By accessing our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you disagree with any part, please do not use our website or services.
1. Our Services
Builtify provides professional digital services including but not limited to:
- Custom website design and development (business, e-commerce, portfolio, enterprise)
- Search Engine Optimization (SEO) — on-page, off-page, technical, and local SEO
- Brand identity design — logo design, business cards, social media kits, brand guidelines
- E-commerce store development with payment gateway integration
- Website maintenance, support, and security monitoring
- Content Management System (CMS) setup and customization
- Progressive Web App (PWA) development
2. Build First, Pay Later Model
Builtify operates on a unique "Build First, Pay Later" model. This means:
- Zero Advance Payment: We do not charge any upfront fees. Work begins immediately upon project agreement.
- Live Preview: You will receive a complete, functional live preview of your project before any payment is due.
- Payment Upon Satisfaction: You pay only when you are 100% satisfied with the delivered work.
- Revision Period: We offer reasonable revisions during the preview phase as specified in your chosen plan.
Important: While no advance is required, once you approve the final deliverable, payment becomes due within 7 business days. Failure to pay after approval constitutes a breach of this agreement.
3. Pricing & Payment Terms
- All prices listed on our website are in Indian Rupees (INR) and are inclusive of development costs
- Domain registration, hosting, and third-party services (if applicable) are charged separately
- Payment can be made via UPI, bank transfer, Razorpay, or other accepted payment methods
- For plans above ₹24,999, payment can be split into two installments — 50% upon approval and 50% within 15 days
- GST (18%) may be applicable for invoiced amounts as per Indian tax regulations
- Late payments may attract a charge of 2% per month on overdue amounts
4. Project Delivery & Timeline
- Personal Plan: 3-5 business days
- Starter Plan: 5-7 business days
- Growth Plan: 10-14 business days
- Enterprise Plan: 21-30 business days (based on scope)
Timelines are estimates and may vary based on project complexity, client responsiveness, and content availability. Delays caused by the client (late content delivery, prolonged feedback cycles) will extend the deadline accordingly.
5. Revisions & Modifications
- Each plan includes a specified number of revisions as listed on the pricing page
- Additional revisions beyond the included limit may be charged at ₹500 per revision
- Major scope changes (adding new pages, features, or functionality not in the original agreement) will be quoted separately
- Revision requests must be submitted within 14 days of the initial delivery
6. Intellectual Property
- Client Content: You retain ownership of all content, images, text, and branding materials you provide to us
- Deliverables: Upon full payment, all rights to the delivered website, design files, and assets transfer to you
- Pre-Payment: Until payment is completed, Builtify retains all rights to the created work
- Portfolio Rights: We reserve the right to showcase completed projects in our portfolio unless you explicitly opt out in writing
- Third-Party Assets: Certain tools, libraries, and fonts used may be subject to their own licenses (e.g., open-source licenses)
7. Client Responsibilities
To ensure smooth project delivery, you agree to:
- Provide all required content (text, images, logos, brand guidelines) in a timely manner
- Respond to communications and approval requests within 48 hours
- Ensure all content provided is legally owned by you or used with proper licensing
- Provide accurate business information for all relevant pages
- Not use our services for illegal, harmful, or fraudulent purposes
8. Cancellation & Refund Policy
- Before Delivery: You may cancel at any time before the preview is delivered at no cost
- After Preview, Before Payment: If you choose not to proceed after seeing the preview, you are not obligated to pay, but the work remains our intellectual property
- After Payment: Refunds are not available once payment has been made and the final files/access have been delivered
- Partial Completion: If a project is cancelled mid-development at the client's request after significant work, a fair compensation may be mutually agreed upon
9. Website Hosting & Domain
- Builtify does not provide hosting or domain registration by default. These are the client's responsibility unless specifically included in a package
- We can recommend and assist with hosting setup and domain configuration for an additional fee
- If hosting/domain is included in your plan, renewal charges are billed annually and are non-refundable
10. Website Maintenance
- Post-delivery support is available as specified in your chosen plan
- Extended maintenance plans are available starting at ₹999/month
- Maintenance includes security updates, performance monitoring, content edits (up to specified hours), and uptime monitoring
- Major feature additions or redesigns during maintenance period require a separate quote
11. User Accounts & Security
- Account creation requires email verification via OTP
- You are responsible for maintaining the confidentiality of your login credentials
- You must not share your account with unauthorized individuals
- Builtify reserves the right to suspend accounts involved in suspicious, abusive, or fraudulent activities
- Admin dashboard access is restricted to authorized Builtify staff only
12. Reviews & Testimonials
- Clients may submit reviews through our website. All reviews are subject to moderation before publication
- Reviews must be genuine, truthful, and based on real service experience
- We reserve the right to reject or remove reviews that contain inappropriate content, spam, or false claims
- By submitting a review, you grant Builtify permission to display it publicly with your name and avatar
13. Limitation of Liability
- Builtify shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services
- Our total liability shall not exceed the amount paid by you for the specific service in question
- We are not responsible for losses due to hosting outages, domain expiry, or third-party service failures outside our control
- We do not guarantee specific SEO rankings, traffic increases, or revenue growth, as these depend on many external factors
14. Disclaimer
Our services are provided on an "as-is" and "as-available" basis. While we strive for excellence in every project, we make no warranties or representations regarding:
- Uninterrupted or error-free operation of delivered websites
- Specific search engine rankings or traffic results
- Compatibility with every browser, device, or operating system
- Revenue generation or business outcomes from the delivered website
15. Indemnification
You agree to indemnify and hold harmless Builtify, its founders, employees, and affiliates from any claims, losses, damages, or expenses (including legal fees) arising from:
- Your breach of these Terms
- Content you submit that infringes third-party rights
- Misuse of the delivered website or services
- Any illegal activity conducted through the website we build for you
16. Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes shall be resolved through:
- Step 1: Amicable negotiation between the parties
- Step 2: Mediation by a mutually agreed mediator
- Step 3: Legal proceedings under the jurisdiction of courts in Patna, Bihar, India
17. Modifications to Terms
Builtify reserves the right to modify these Terms at any time. Material changes will be announced by updating the "Last updated" date on this page. Continued use of our website or services after modifications constitutes acceptance of the updated Terms.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
